Defense attorney Don Darnicola said he was certain there was not enough gunpowder to fire the fatal shot. "The law says there should be evidence of the commission of a crime," he said. "The boy's death is very tragic." Darnicola told the court during cross-examination that the boy's parents had had an argument, resulting in the son being shot twice, and that both were sleeping on the couch with their son and his grandparents. The defense attorney also called a witness who said that he had seen the child's hair and that it was black. He said the boy's grandmother had noticed that the child was wearing gloves, and that her son told her he was scared. Darnicola asked the defense to ask the girl to describe her son's behavior and then pointed out that the boy had been placed under arrest because of a burglary before the shooting.
